Tavoittaja Service Terms and Conditions

The Service refers to the Tavoittaja service, including features added by the provider and customer support. The Service is limited to Tavoittaja’s own software and does not include services provided by network operators or other third parties that are connected to the Tavoittaja service. The development and servers of the Tavoittaja service are located in Finland.  

The Provider refers to Prospectum Oy (Business ID 2353129-3), the owner and administrator of the Tavoittaja service.  

The Customer refers to a company or organization registered for the Tavoittaja service, as well as its representatives and individuals authorized to use the service.  

  1. By accepting the Terms and Conditions, the Customer agrees to and confirms that the Terms described herein have been understood and will be complied with. The Terms and Conditions are presented in the service registration form and are available in the service’s customer interface. Registration for the service requires acceptance of the valid Terms and Conditions.  
  1. Amendments to the Terms and Conditions take effect immediately or at a later date as separately communicated. The amended Terms apply to all users of the Service from the date of entry into force. If the Customer does not accept the amended Terms, they must discontinue use of the Service. Continued use of the Service constitutes acceptance of the current Terms and Conditions.  
  1. Failure to comply with the Terms and Conditions may result in termination of the agreement, closure of the customer account, forfeiture of funds, and/or legal action against the Customer.  
  1. The person registering for Tavoittaja must represent a registered company or organisation , and the person activating the service must have the legal authority to act on behalf of the respective company as the responsible party in the Tavoittaja service. 
  1. Each Customer may have only one (1) customer account in Tavoittaja, unless otherwise specifically agreed with Tavoittaja. If a company or organization requires multiple customer accounts, Tavoittaja must be contacted in advance. 
  1. When registering, the Customer must provide all information accurately and ensure that their information is updated correctly in the event of changes. Tavoittaja has the right to send information about its own services/products to the address provided by the Customer. 
  1. Free text message credits provided by Tavoittaja, as well as text message credits purchased from Tavoittaja, cannot be converted into cash. 
  1. Tavoittajassa ostetut krediitit ovat voimassa 365 päivää uusimmasta ostohetkestä.
  1. The Customer understands that they are solely responsible for ensuring that their use of the Service complies with the laws and regulations applicable in Finland and the European Union.   
  1. The Service is intended for communication and marketing by companies and organisations . It is not intended for personal communication between private individuals. 
  1. When sending text messages, the Customer must ensure that the message content and sender name are not in any way offensive, abusive, derogatory, misleading, or contrary to good practices. The Customer is responsible for all content and sender names used in their text messages. 
  1. If misuse of the Service is suspected, Tavoittaja reserves the right to monitor message traffic. 
  1. If Tavoittaja detects or suspects that the Customer is acting in violation of the Terms and Conditions, Tavoittaja has the right to immediately close the Customer’s account without prior notice. Credits in a closed account will not be refunded. 
  1. Tavoittaja stores the contacts saved by the Customer in the service in an encrypted form. 
  1. The Customer must keep the password received from Tavoittaja secure and ensure it is not accessible to unauthorized parties. 
  1. If the Customer notices, discovers, or becomes aware of a technical issue or similar problem in Tavoittaja that hinders or could hinder the Service, the Customer must immediately report it to Tavoittaja’s customer support. If the Customer deliberately exploits any technical or other problem, Tavoittaja reserves the right to seek full compensation for damages. 
  1. If it is discovered that the Customer is misusing free text message credits, for example with fabricated contact information, Tavoittaja has the right to charge for all misused credits in full. In addition, Tavoittaja has the right to invoice for any investigation or other work related to the misuse at a rate of €120 + 25.5% VAT, i.e., €150.60 per hour. The minimum billing is three (3) hours, totaling €451.80 including VAT. 
  1. If the Customer pays with Visa, Visa Electron, or MasterCard, Tavoittaja (i.e., Prospectum Oy) acts solely as the marketer of the products and services and is also responsible for delivering the products to the purchaser. 
     
    The payment processing and payment service provider is Paytrail Oyj (business ID 2122839-7), in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the payee on bank statements or card statements and forwards the payment to the merchant. Paytrail Oyj holds a payment institution license. In case of complaints, please contact the product supplier as the first point of contact.

  1. Tavoittaja is not responsible if the data stored by the Customer in the system (such as address lists, contact information, bank details, or other data added by the Customer) is lost, damaged due to a system error, or collected in violation of laws or regulations. The Customer understands that data storage is designed to be as secure and reliable as possible, but the possibility of technical or other errors can never be entirely excluded. The Tavoittaja service can never be the Customer’s primary and sole storage location for their data. 
  1. Tavoittaja is not responsible if the Customer is unable to send text messages at a desired moment or if the Tavoittaja service is temporarily unavailable. During periods of high traffic, message delivery times may be delayed or the sending speed may be slower than normal. 
  1. The Customer is responsible for the right to use the contacts stored in Tavoittaja. The Customer must ensure that contacts are stored and used in accordance with applicable data protection laws and regulations, see e.g. https://gdprinfo.eu/ 
  1. In the Tavoittaja service, message delivery history including recipient information is available for the current calendar year and the preceding calendar year. For example, during 2024, recipient information from messages sent from the start of 2023 is available. When the calendar year changes to 2025, recipient information from messages sent in 2023 and earlier will be deleted. 
  1. If the Customer has not sent any messages through the Tavoittaja service for two consecutive calendar years, Tavoittaja reserves the right to delete the Customer’s account and all data stored in the account. The account and stored data cannot be restored. After the account is deleted, the Customer has the right to open a new account. 
  1. Tavoittaja is not responsible if the Customer is unable to send text messages at a desired moment or if the Tavoittaja service is temporarily unavailable. During periods of high traffic, message delivery times may be delayed or the sending speed may be slower than normal. 
  1. Tavoittaja is released from all liability in the event of Force Majeure. Examples of force majeure events include natural disasters, war, cyberattacks, and other similar unforeseeable circumstances that have a significant impact on operations. 
  2. Tavoittaja pidättää oikeuden muutoksiin hinnoittelussa.
  3. The interpretation of the Terms and Conditions is always governed by Finnish law, and any issues will primarily be resolved through mutual negotiations. If negotiations do not yield results, the matter may, if necessary, be brought before the District Court of Jyväskylä. 

The Terms and Conditions are valid until further notice. Tavoittaja reserves the right to amend the Terms. All changes will be announced on Tavoittaja’s website at www.beta.tavoittaja.fi.
